Control Yours (Auxway LLC, a Nebraska company, d/b/a Control Yours) designs, builds, hosts, and manages websites, digital advertising, and custom business tools for clients. This policy explains what personal information we collect, how we use it, and the choices you have.

It applies to controlyours.com, our client portal at my.controlyours.com, our phone and text-message lines, and the services we provide under our Terms & Conditions. It does not cover the websites we build and host for clients; those sites are controlled by the client, who is responsible for their own privacy practices.

Information we collect

We collect only what we need to run the business and serve clients.

  • Contact details you give us: name, business name, email address, phone number, and mailing address, whether through a form, a sign-up, a call, a text, or in person.
  • Account and billing information when you become a client: login credentials for the client portal, service selections, and payment details. Card and bank information is entered directly with our payment processors (Wells Fargo Merchant Services, LLC and Check Commerce) and is not stored on our systems.
  • Communications with us: emails, text messages, voicemails, call recordings, and support requests.
  • Website usage on controlyours.com: pages visited, device and browser type, approximate location from your IP address, and referral source, collected through cookies and analytics tools described below.
  • Content you provide for your project: text, images, logos, and other materials you ask us to publish on your behalf.

How we use information

We use personal information to deliver and support the services you ask for.

  • Build, host, maintain, and support your website, advertising campaigns, or business tools.
  • Set up and manage your client account, process payments, and send invoices.
  • Respond to calls, texts, emails, and support requests.
  • Send service notices such as billing reminders, outage alerts, and project updates.
  • Improve our website and services by understanding how they are used.
  • Comply with legal obligations and protect against fraud or misuse.

We do not use your personal information for automated decisions that have legal effects on you, and we do not sell it.

Text messaging (SMS/MMS)

We use text messaging to communicate with clients and prospective clients who contact us. We do not send marketing or promotional text campaigns.

  • Consent. You consent to receive texts from us by texting our business number first, by providing your mobile number when you call or email us, or by giving us your number during sign-up or a support request and asking us to text you.
  • What we send. Replies to your questions, project and support updates, appointment confirmations, and account or billing notices. Message frequency varies with your activity.
  • Costs. Message and data rates may apply according to your mobile carrier’s plan.
  • Opting out. Reply STOP to any message to stop receiving texts from us. Reply HELP for help, or contact us using the details at the end of this policy.
  • No sharing. Mobile phone numbers and text-messaging consent are not sold, rented, or shared with third parties or affiliates for marketing purposes. Text message opt-in data and consent will not be shared with any third parties, except with the service providers that deliver messages on our behalf.
  • Carriers. Carriers are not liable for delayed or undelivered messages.

Call recording

Calls to and from our business phone lines may be recorded and transcribed for quality assurance, training, and record keeping. Callers hear a notice before the call connects. Recordings and transcripts are stored on our own systems, accessible only to Control Yours staff, and retained as described under Data retention below. If you prefer not to be recorded, you can tell us and continue the conversation by email.

Cookies and analytics

Our website uses cookies and similar technologies to keep the site working, remember your preferences, and understand how visitors use it.

  • Essential cookies keep you logged in to the client portal and remember items in your cart. The site does not work properly without them.
  • Analytics (Google Analytics 4, loaded through Google Tag Manager) tells us which pages are visited and how visitors arrive. Google may set its own cookies; see Google’s privacy policy and its opt-out tool.
  • Advertising and remarketing tags from Google Ads (conversion tracking and remarketing) and Meta (the Meta pixel, Events Manager, and Custom Audiences) may record that you visited our site so we can measure our own advertising and show relevant ads on Google and on Facebook/Instagram. You can adjust ad preferences in your Google and Meta account settings.
  • Embedded content from third parties may set their own cookies when it loads: Google Fonts and Adobe Fonts (typefaces), Vimeo (video), Calendly (scheduling), Typeform (forms), and Google reCAPTCHA (spam protection). Each is governed by that provider’s privacy policy.

Most browsers let you block or delete cookies in their settings. Blocking essential cookies may prevent parts of the site from working.

How we share information

We do not sell personal information, and we do not share it with third parties for their own marketing. We share it only in these cases:

  • Service providers that help us operate, under agreements that limit their use of the data:
    Hosting, security, and delivery
    Cloudflare, Vercel, DigitalOcean
    Payments and billing
Stripe, PayPal, Recurly, Wells Fargo Merchant Services, LLC, and Check Commerce
    Email and productivity
Google Workspace; transactional email through SparkPost; client newsletters and automated email through ActiveCampaign
    Support and scheduling
Help Scout (support tickets), Calendly (meeting booking), Typeform (forms and surveys)
    Phone and messaging
    Ubiquiti UniFi Talk
    Spam protection
Google reCAPTCHA and Akismet on our contact forms
    Analytics and advertising
Google and Meta, as described under Cookies and analytics
  • Advertising platforms when you ask us to run campaigns for you, limited to what the campaign requires.
  • Domain registrars and certificate authorities when registering or renewing a domain on your behalf, which requires contact details in public or registrar records.
  • Legal requirements, such as a subpoena, court order, or a request to protect our rights, safety, or property.
  • Business transfers, if Control Yours is sold or merged, in which case this policy continues to apply to the transferred data.

Data retention and security

We keep personal information only as long as we need it for the purposes above.

  • Client account and billing records are kept for the life of the account and for seven years afterward to meet tax and accounting requirements.
  • Call recordings, voicemails, and transcripts are kept for up to two years, then deleted.
  • Text messages and emails are kept as part of the client record and deleted when the account record is.
  • Website analytics data is retained according to Google Analytics settings, currently 14 months.
  • Prospect inquiries that do not become clients are deleted after two years of no contact.

We protect information with encryption in transit (HTTPS/TLS), access limited to staff who need it, multi-factor authentication on our business systems, and hosting providers that hold SOC 2 Type 2 or ISO 27001 certifications. No method of storage is perfectly secure; if we learn of a breach affecting your personal information, we will notify you as required by law.

Your choices and rights

You can ask us at any time to see, correct, or delete the personal information we hold about you, or to stop using it for a particular purpose. Contact us using the details at the end of this policy; we will respond within 30 days and may ask you to verify your identity first.

  • Marketing emails: use the unsubscribe link in any message.
  • Text messages: reply STOP.
  • Cookies and ads: see the Cookies and analytics section.
  • Client portal: log in to update your own contact and billing details.

Residents of California and other U.S. states with privacy laws (including Colorado, Connecticut, Virginia, Utah, Texas, and Oregon) have the right to know what personal information we collect and how we use and share it, to access and delete it, to correct it, and to opt out of its sale or sharing for targeted advertising. We do not sell personal information. To opt out of advertising cookies, use the browser and platform controls described above. We will not discriminate against you for exercising these rights. You may use an authorized agent to submit a request on your behalf.

Residents of the European Economic Area, United Kingdom, or Switzerland: we serve clients in the United States and do not target these regions, but if we hold your data you have the rights of access, rectification, erasure, restriction, portability, and objection under the GDPR, and the right to lodge a complaint with your local supervisory authority. Our legal bases for processing are performance of a contract, our legitimate interest in running and improving the business, and your consent where we ask for it.

Children’s privacy

Our services are for businesses and adults. Clients must be 19 or older under our Terms & Conditions, and we do not knowingly collect personal information from anyone under 13. If you believe a child has given us personal information, contact us and we will delete it.

Changes to this policy

We may update this policy as our services or the law change. The effective date at the top shows the current version. For material changes, we will post a notice on our website or email active clients before the change takes effect.
